ब्रिटिश कंपनी राज के आरंभ मे कई बार व्यक्ति को कैद करने बाद भी जल्दी बताया भी नहीं जाता था की उसे कैद किस अपराध के लिए किया गया हैं। 1857 की स्वतंत्रता क्रांति के बाद कई कानूनों मे बदलाव करना ब्रिटिश राज के लिए आवश्यक हो गया था, क्यू की 1857 के क्रांति के कई अभियुक्त अभी भी कैद मे थे और भले ही क्रांति विफल रही पर उस मशाल ने हर नागरिक के मन मे स्वतंत्रता की ज्योति जला दी थी।
बीएनएसएस की पहली धारा कानून को औपचारिक रूप देती है। यह बताती है कि इस संहिता का नाम भारतीय नागरिक सुरक्षा संहिता, 2023 है। यह संहिता जम्मू-कश्मीर सहित पूरे भारत पर लागू होती है। पर इस संहिता के अध्याय 9, 11 और 12 के प्रावधान और उससे जुड़े अन्य प्रावधान पूरे नागालैंड और आसाम के उन जनजातीय क्षेत्रों मे लागू नहीं होंगे जिनका समावेश संविधान की छठी सूची के पैरा 20 मे दि. 21 जनवरी 1972 के ठीक पहले किया गया था।
