2.34 Restriction on future employment by Chairperson and members:

2.34.1 Bare Act Provision:

20K. Restriction on future employment by Chairperson and members.―On ceasing to hold office, the Chairperson or whole-time member of the Authority, as the case may be, shall, subject to the provisions of this Act, be ineligible, for a period of five years from the date on which they cease to hold office, for further employment (including as consultant or expert or otherwise) in any institution, agency or organisation of any nature mainly dealing with archaeology, country and town planning, architecture, heritage and conservation-architecture or whose matters had been before the Chairperson or such member.

2.34.2 Restriction on Future Employment

Section 20K of the Ancient Monuments and Archaeological Sites and Remains (AMASR) Act, imposes a five-year restriction on future employment for the Chairperson and whole-time members of the National Monuments Authority (NMA) after leaving office. This provision aims to prevent conflicts of interest and maintain the NMA’s integrity.

After leaving their position, the Chairperson and full-time NMA members cannot take jobs including consulting or expert roles for five years in organizations focused on archaeology, town planning, architecture, heritage, or conservation-architecture, or in organizations whose issues they handled while in office.[1] This applies unless other parts of the AMASR Act allow exceptions. This provision prevents conflicts of interest by ensuring former NMA Chairperson and full-time members do not use their position, knowledge, or connections for personal gain in related fields. The five-year restriction promotes impartiality and public trust, safeguarding the integrity of decisions made during their tenure.
