Bare Act Definitions with explanation:
3. Definitions:
(1) In these regulations, unless the context otherwise requires-
(a) “Act” means the University Grants Commission Act, 1956 (3 of 1956);
The University Grants Commission Act, 1956 is the main Indian law (passed in 1956) that created the UGC and gives it powers to regulate and fund universities.
(b) “Aggrieved Person” means a person who has any complaint in the matters relating to or connected with the grievances under these regulations;
In short the aggrieved person is someone who feels wronged or has a problem connected to these rules.
(c) “Caste-based discrimination’’ means discrimination only on the basis of caste or tribe against the members of the scheduled castes, scheduled tribes, and other backward classes;
In short Caste-based discrimination is unfair treatment purely due to caste, targeting SC, ST, or OBC persons as per this regulation.
(d) “Commission” means the University Grants Commission established under the University Grants Commission Act, 1956;
In simple words UGC, the main government organisation created by the 1956 Act to oversee higher education in India.
(e) “Discrimination” means any unfair, differential, or biased treatment or any such act against any stakeholder, whether explicit or implicit, on the grounds only of religion, race, caste, gender, place of birth, disability, or any of them. It also includes any distinction, exclusion, limitation, or preference which has the purpose or effect of nullifying or impairing equality of treatment in education and, in particular, of imposing conditions on any stakeholder or group of stakeholders which are incompatible with human dignity.
“Discrimination” means any unfair, biased, or different treatment, whether open or hidden, given to any person involved in higher education only because of their religion, race, caste, gender, place of birth, disability, or a combination of these. It also covers any rule, exclusion, or preference that harms equality in education or treats someone in a way that violates their human dignity. In short unfair treatment based solely on protected characteristics like caste, gender, religion, etc., that affects equality or dignity in education.
(f) “Equity” means a level playing field for all stakeholders with respect to the entitlement and opportunity for the enjoyment of all legitimate rights.
“Equity” means creating a fair and level playing field for everyone involved, so that all stakeholders have equal entitlement and genuine opportunities to enjoy their legitimate rights. In simple words it is fairness in practice ensuring everyone gets an equal and real chance to access their rights, without unfair barriers.
(g) “Equity Committee” means the Committee constituted by the head of the higher education institution.
A special committee set up by the higher education institution’s head to handle matters related to equity, fairness, and non-discrimination.
(h) “Equity Helpline” means a helpline established and operated by an HEI;
“Equity Helpline” means a dedicated helpline (phone, email, or other contact service) that is set up and run by the Higher Education Institution (HEI) itself for purpose of the UGC equity regulations of 2026.
(i) “Equal Opportunity Centre” means the centre established under these Regulations by an HEI;
“Equal Opportunity Centre” means the dedicated centre that a HEI is required to establish under these Regulations.
(j) “Faculty Members” means teachers who are working for the HEI;
“Faculty Members” means all teachers who are employed by or working for the HEI.
(k) “Gender” means and includes male, female, and third gender;
“Gender” means and includes male, female, and third gender i.e. transgender or non-binary identities.
(l) “Grievance” means and includes complaint(s) made by an aggrieved person in respect of discrimination under these regulations;
“Grievance” means any complaint or complaints made by an aggrieved person regarding discrimination as defined under these regulations.
(m) “Head of the Institution” means the Vice-Chancellor in case of a university or a Deemed to be university, the Principal or the Director or such other designation as the executive head of the institution or the college is referred;
“Head of the Institution” means the top executive authority of the higher education institution, specifically, the Vice-Chancellor in the case of a university or deemed university, and the Principal, Director, or any other person designated as the executive head in the case of a college or other institution.
(n) “Higher Education Institutions (HEIs)” means a university within the meaning of clause (f) of section 2, a college within the meaning of clause (b) of sub-section (1) of section 12 A, and an institution deemed to be a university, declared under section 3 of the University Grants Commission Act, 1956;
“Higher Education Institutions (HEIs)” means any university, college, or institution deemed to be a university, as defined under the relevant sections of the University Grants Commission Act, 1956.
(o) “Ombudsperson” means the Ombudsperson appointed under the University Grants Commission (Redressal of Grievances of Students) Regulations, 2023, as amended from time to time;
“Ombudsperson” means the independent official appointed under the UGC (Redressal of Grievances of Students) Regulations, 2023 and any later amendments, to handle and resolve student grievances fairly.
(p) “Staff” means the persons, other than faculty members, who are working for the HEI;
Staff means everyone working in the college/university who is not a teacher/professor.
(q) “Stakeholders” means students, faculty members, staff, and members of the managing committee, including the Head of the HEI;
Stakeholder means everyone who studies, teaches, works, or governs or manages the college or university.
(r) “Student” means a person enrolled, or seeking admission to be enrolled, in any HEI through any mode, i.e., Formal, Open and Distance Learning (ODL), or Online;
Student means anyone studying or trying to get admitted in a college or university, no matter if it’s full-time, distance, or online.
(s) “University” means a university established or incorporated by or under a Central Act, a Provincial Act, or a State Act and includes any such institution as may, in consultation with the University concerned, be recognized by the Commission in accordance with the regulations made in this behalf under the Act;
University means A university created by any Indian law whether central, old provincial, or state, as well as any other institution officially recognised by UGC as equivalent to a university.
(2) Words and expressions used and not defined herein but defined in the Act or in the General Clauses Act, 1897, shall have the meanings as respectively assigned to them in the Act or in the General Clauses Act, 1897, as the case may be.
This clause acts as a legal bridge. It ensures that any technical terms or legal phrases not specifically defined within the 2026 regulations will take their meanings from two main sources: the University Grants Commission Act of 1956 or the General Clauses Act of 1897. Essentially, it prevents legal gaps by using established dictionaries of law to interpret the regulations.
