This provision is adopted as Section 5 of the AMASR Act with some modifications. The colonial policy of acquisition is having an impression on the Section 5 of AMASR Act which is in force, causing serious violation of the rights related to holding property.

3.1 Criticism of adopted definitions:

The definition of “ancient monument” in the AMASR Act of 1958 is outdated and incompatible with modern heritage preservation needs, primarily due to its rigid 100-year age threshold, which excludes significant 20th and 21st century sites like modernist architecture, industrial relics, or conflict memorials that hold contemporary cultural, scientific, or social value.
