2.47 Compensation for loss or damage<\/u><\/strong><\/p>\n\n\n\n

2.47.1 Bare Act Provision:<\/strong><\/h3>\n\n\n\n

PRINCIPLES OF COMPENSATION<\/em><\/p>\n\n\n\n

27. Compensation for loss or damage.\u2015Any owner or occupier of land who has sustained any loss or damage or any diminution of profits from the land by reason of any entry on, or excavations in, such land or the exercise of any other power conferred by this Act shall be paid compensation by the Central Government for such loss, damage or diminution of profits.<\/em><\/p>\n\n\n\n

Section 27 of the Ancient Monuments and Archaeological Sites and Remains (AMASR) Act, provides for compensation to landowners or occupiers who suffer losses due to activities under the<\/p>\n\n\n\n

2.47.2 Compensation for Loss or Damage<\/strong><\/h3>\n\n\n\n

As per Section 27 of the AMASR Act<\/a>, if a landowner or occupier experiences loss, damage, or reduced profits due to activities like entry, excavations, or other actions, e.g., compulsory acquisition or restrictions, carried out under the AMASR Act, the Central Government must pay them compensation for these losses. This provision ensures fairness by compensating landowners or occupiers for financial or property losses caused by heritage protection activities, balancing the public interest in preserving Bharat\u2019s cultural heritage with the private rights of individuals affected by such actions.<\/p>\n\n\n\n

Section 27 provides that the owner or occupier of the land who has sustained any loss or damage or any diminution of profits due to exercise of any other power conferred by AMASRA, shall be paid compensation by the Central Government for the extent of such loss, damage etc.[1]<\/p>\n\n\n\n
