2.59 Obligation to survey the protected prohibited area and regulated areas<\/u><\/strong><\/p>\n\n\n\n

2.59.1 Bare Act Provision:<\/strong><\/p>\n\n\n\n

1[35A. Obligation to survey the protected prohibited area and regulated areas.\u2015(1) The Director-General shall, within such time as may be specified by the Central Government, conduct a survey or cause survey to be conducted in respect of all prohibited areas and regulated areas for the purpose of detailed site plans.<\/em><\/p>\n\n\n\n

(2) A report in respect of such survey referred to in sub-section (1) shall be forwarded to the Central Government and to the Authority.<\/em><\/p>\n\n\n\n

Section 35A of the Ancient Monuments and Archaeological Sites and Remains (AMASR) Act, mandates the Director-General to conduct surveys<\/a> of prohibited and regulated areas and report the findings.<\/p>\n\n\n\n

2.59.2 Obligation to Survey<\/strong><\/p>\n\n\n\n

The Director-General of the Archaeological Survey of India must, within a timeframe set by the Central Government, either personally conduct or arrange for surveys of all prohibited areas i.e. within 100 meters of a protected monument and regulated areas i.e. within 200 meters after prohibited areas to create detailed site plans. This provision ensures that prohibited and regulated areas are systematically mapped and documented through surveys, providing accurate site plans to guide heritage protection<\/a> and regulate activities like construction, thereby safeguarding Bharat\u2019s cultural heritage.<\/p>\n\n\n\n

2.59.3 Submission of Survey Report<\/strong><\/p>\n\n\n\n

The Director-General must send a report of the survey<\/a> results, including the detailed site plans, to both the Central Government and the National Monuments Authority (NMA). This provision promotes transparency and coordination by requiring the survey findings to be shared with the Central Government and NMA, enabling informed decision-making and oversight to ensure effective management of protected areas.<\/p>\n\n\n\n
