Constituent Assembly was full of freedom fighters, but still few of prominent politicians, who were members, are either blamed or given extra ordinary credit. This series is nothing but unveiling the truth behind the making of our Constitution and giving credit to right person.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">CAD: Wednesday, the 11th December, 1946<\/h2>\n\n\n\n<p>The third day of the Constituent Assembly was of highly importance. The group of men including few <a href=\"https:\/\/bharatlex-rinkutai.com\/?page_id=918\" data-type=\"page\" data-id=\"918\">women <\/a>were working hard for framing the law of the land, but some separatists belonging to Muslim League were absent and they were the cause for delay. Still there were few, like old Hindu Mahasabha leader, member of Swaraj Party, Dr. M R Jayakar, who entered the Constituent Assembly on Congress Ticket was in hope that Muslim League would join hands in very short time. Why people have some hopes from these separatist elements?<\/p>\n\n\n\n<p>Well the third day was of election of the permanent Chairman of the Constituent Assembly. J B Kripalani proposed name of Dr. Rajendra Prasad and Sardar Vallabhbhai Patel was seconder in this nomination. This nomination paper was valid as it was in the prescribed manner. Harekrushna Mahtab with seconder Nand Kishor Das also nominated Dr. Rajendra Prasad, in the perfect nomination format notice.<\/p>\n\n\n\n<p>Nomination proposal of Mr. Prakasam was beyond time and no seconder had signed the same. Sir S Radhakrishanan also proposed Dr. Rajendra Prasad, but it was not having any seconder and any endorsement from Dr. Rajendra Prasad. As there was no other nomination paper submitted, Dr. Rajendra Prasad was declared as the permanent Chairman of the Constituent Assembly. Then Rajendra Prasad was conducted to the chair by Acharya Kripalani and Maulana Abul Kalam Azad.<\/p>\n\n\n\n<p>Then congratulations speeches were given by various leaders. Here are some important quotes from these speeches.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sir S Radhakrishnan of United Provinces:<\/h3>\n\n\n\n<p>Complete speech is much long, but here are some quotes in italics from the speech of Sir S Radhakrishnan.<\/p>\n\n\n\n<p><em>This Constituent Assembly has met here to frame the constitution, to effect the withdrawal of <a href=\"https:\/\/bharatlex-rinkutai.com\/?tag=colonial-policy\" data-type=\"post_tag\" data-id=\"55\">British control<\/a>, political, economic and military and to establish a free independent India. If successful, this transfer of authority will be the biggest and the least bloody of all transfers in human history.<\/em><\/p>\n\n\n\n<p><em>Playing off one section against another is unworthy of a great people.<\/em><\/p>\n\n\n\n<p><em>A constitution is the fundamental law of the nation. It should embody and express the dreams and passions, the ideals and aspirations of the people. It must be based on the consent of all, and respect the rights of all people who belong to this great land.<\/em><\/p>\n\n\n\n<p><em>India never asked the Parsis or the Jews or the Christians or the Muslims who came and took shelter there to change their creeds or become absorbed in what might be called a uniform Hindu humanity.<\/em><\/p>\n\n\n\n<p><em>Suicide is the greatest sin. To murder yourself, to betray yourself, to barter away your spiritual wealth for a mess of pottage, to try to preserve your body at the expense of your spirit-that is the greatest sin.<\/em><\/p>\n\n\n\n<p><em>We have to remember with gratitude all those great souls who worked and suffered for the freedom of this country, for the dawn of this day. Thousands died, more thousands suffered privation, imprisonment, and exile.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sir N Gopalswami Ayyangar of Madras<\/h3>\n\n\n\n<p>Here are some important quotes from the speech of The Hon&#8217;ble Diwan Bahadur Sir N. Gopalaswami Ayyangar of Madras Province.<\/p>\n\n\n\n<p><em>That constitution derives its authority not from the fact that its authors were three Members of His Majesty&#8217;s Government but from the fact that the proposals made therein have been accepted by the people of this country.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mr. F. R. Anthony<\/h3>\n\n\n\n<p>Mr. F R Anthony was from Bengal Presidency and he also gave congratulations speech for Dr. Rajendra Prasad for being unanimously elected as the Chairman of the Constituent Assembly. Some of his important quotes from his speech are as follows:<\/p>\n\n\n\n<p><em>I believe also that it is the natural and fervent impulse of every Indian, irrespective of community, to strive increasingly for the increasing greatness of our mother country.<\/em><\/p>\n\n\n\n<p><em>I also believe that whatever difference of language, of community or of social life that must inevitably exist in a great country such as ours, leaders possessing the quality of liberality and breadth of vision will succeed ultimately in joining all these different communities into one stream which will carry on its course, surging forward irresistibly, enabling this country to take her place, her rightful place in the vanguard of the great nations of the world.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Dr. J. A. D&#8217;Souza of Madras<\/h3>\n\n\n\n<p><em>When Burke, referring to the imperial control of England over her Indian Empire, applied to it the doctrine of trusteeship. He declared that as soon as the child India comes of age the trusteeship must end.<\/em><\/p>\n\n\n\n<p><em>When I cast a glance along the first benches of this great Assembly I note that there are great personalities who could play the role of a Churchill or a Roosevelt or a Stalin and not only play the role but even go one better. This is so far as the top ranks of the citizenhood of India is concerned.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sir V. I. Munishwami Pillai of Madras:<\/h3>\n\n\n\n<p><em>It was in 1890, when one of our revered leaders of our Province sent in open letter to the Hon&#8217;ble Members of the House of Commons showing the helplessness of the untouchable classes but it was given to Mahatma Gandhi, Sir, in the year 1932 to chalk out in what way these communities could be helped.<\/em><\/p>\n\n\n\n<p><em>Sir, the 60 millions of untouchables form the backbone of <a href=\"https:\/\/bharatlex-rinkutai.com\/?page_id=237\" data-type=\"page\" data-id=\"237\">Hinduism <\/a>and I am sure, that in your deliberations in framing the constitution you will see that all the disabilities of the Harijans are taken note of and remedied in a manner that they may enjoy equal privileges in this great country.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mr. Somnath Lahiri of Bengal<\/h3>\n\n\n\n<p><em>I wish we could declare from this Assembly that we are not to be led by the illusions created by British imperialism and its Cabinet Mission plan regarding transfer of power. But I know that illusions die hard. I hope we will have your help in dispelling those illusions and making the people of India again wage the most determined and united struggle against a Plan, a diabolical Plan, which has already reduced us to become a laughing stock of the world.<\/em><\/p>\n\n\n\n<p><em>What I would expect of Dr. Rajendra Prasad as permanent Chairman of this Assembly is to help us in dispelling our countrymen&#8217;s illusions, to help us to place our point of view in full, to throw away this Cabinet Mission&#8217;s Plan and all its award and everything else and be united and fight.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mr. Jaipal Singh of Bihar<\/h3>\n\n\n\n<p>Jaipal Singh was representative of aboriginal tribe of Chhota Nagpur. Here how he represented his tribe:<\/p>\n\n\n\n<p><em>I want to say a few words in congratulating Dr. Rajendra Prasad, especially on behalf of the community I represent. So far as I have been able to count, we are here only five. But we are millions and millions and we are the real owners of India.<\/em><\/p>\n\n\n\n<p><em>I do hope that this is only a stage for the real rehabilitation and resettlement of the original people of India. Let the British quit. Then after that, all the later-comers quit.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mrs. Sarojini Naidu:<\/h3>\n\n\n\n<p><em>Today we are steeped in the rainbow coloured tints of speeches in praise of my great leader and comrade Rajendra Prasad.<\/em><\/p>\n\n\n\n<p><em>I see gaps in this House and my heart is sore because of the absence of those Muslim brothers to whose coming I am looking forward under the leadership of my old friend Mr. Muhammad Ali Jinnah.<\/em><\/p>\n\n\n\n<p><em>I am hoping and I believe I am right in hoping that my friend Dr. Ambedkar who is so bitter today will soon be one of the most emphatic supporters of this Constituent Assembly in all its purposes and that through him his adherents of many millions will realise that their interests are as safe as the interests of more privileged people. I hope those that call themselves the original masters of this land, the tribal people will realise that there is no distinction of caste, creed, ancient or modern, status in this Constituent Assembly.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Dr. Rajendra Prasad:<\/h3>\n\n\n\n<p><em>Our brethren of the Muslim League are not with us and their absence increases our responsibility. We shall have to think at each step what would they have done if they were here? We have to proceed keeping all these things in view. We hope they will soon come and take their places and share in the deliberations for framing a constitution for their country which will give it freedom, that they will join us in our march for freedom. But if unfortunately these seats continue to remain unoccupied, it will be our duty to frame a constitution which will leave no room for complaint from anybody.<\/em><\/p>\n\n\n\n<p><em>I am hoping that our friends of the Muslim League will soon come to occupy there places and will be glad and happy to participate in this great work of creating a constitution for our people creating a constitution which according to, the experience of all other nations of the world, which according to our own experience and which according to our own traditions and our own peculiar conditions, will guarantee to every one all that can be guaranteed, all that need be guaranteed and all that require to be guaranteed, and will not leave any room for any complaint from any side.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Facts about History from Speeches<\/h3>\n\n\n\n<p>When I was reading all these speeches given in the Constituent Assembly, I observed many things about our History, specifically of British rule. I am mentioning those things from various speeches here, along with the questions which I am having regarding various statements of these members:<\/p>\n\n\n\n<p>Everything was going very smooth, but due to stubbornness of Muslim League, the independence of India was also having the biggest blood shade, due to partition. Churchill was the one who tried influence Muslim League leader Mr. Jinnah, for such blood shade. <\/p>\n\n\n\n<p>A Jesuit Missionary was the first Britisher to arrive in this Country. The British merchants followed him to trade but stayed to rule. Even toady few business tycoons and many non-governmental organizations are entering into this country in the name of business and social work, and we are repeating the same mistakes of believing in them.<\/p>\n\n\n\n<p>In 1930 the Resolution for the Independence of India was passed at Lahore by the Indian National Congress and Constituent Assembly was meant to give effect to that resolution. Although the whole credit is given to Congress, but many of the Congress leaders were from different political organisations at that time.<\/p>\n\n\n\n<p>British through Morley-Minto Reforms introduced the principle of communal electorates. The idea of communal electorates was to just destroy social and communal harmony of this nation, and still it is followed unofficially by political parties. They choose their candidate as per the population percentage of the community and this trend set by the British rulers is very harmful for our Country.<\/p>\n\n\n\n<p>Officially the constitutional law development started with Morley-Minto Reforms, followed by Montford Reforms, Government of India Act, 1935, the Cripps\u2019 proposals and Cabinet Plan.<\/p>\n\n\n\n<p>As I am reading various speeches of freedom fighters turned Constituent Assembly members, given during the debates, I came across various people who glorified the knowledge of English over any other Indian origin language. The same is still glorified in the sense that if a person is not having knowledge of English language, then he\/she is not intelligent. There is no direct connection between intelligence and English language, but only in India we still are carrying the burden of this foreign language, instead of promoting our own languages, which were more sensibly developed.<\/p>\n\n\n\n<p>Also why citizenhood of India required to be copycat of foreign leaders? India itself has many ideals, but members like Dr. J. A. D&#8217;Souza ranked the copycats of Churchill, Roosevelt, Stalin, etc. people, liable of greatest ranks. As from these debates only, Churchill was the main person behind the aggression of separate state for Muslims on religious grounds.<\/p>\n\n\n\n<p>Why British rulers gave the letter from Madras province, regarding helplessness of untouchables, written to House of Commons of Britain? Why this responsibility was not given to Dr. B R Ambedkar?<\/p>\n\n\n\n<p>Somnath Lahiri who was of Communist ideology was criticizing Cabinet Mission Plan, but he was interrupted by Dr. Sinha. Why Dr. Sinha was interrupting members who were really trying to avoid British ideas to be integrated in the Constitution of India? Although I do not support communist ideology, present in India in 21<sup>st<\/sup> century, but some points raised by age old British era communist leaders were notable.<\/p>\n\n\n\n<p>According to speech of Sarojini Naidu, Dr. B R Ambedkar was not in favour of Constituent Assembly and making of the Constitution by Indian people. This is the topic of research.<\/p>\n\n\n\n<p>Well after all these speeches, Assembly started again its work.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Election of the Committee for Rules of Procedure:<\/h2>\n\n\n\n<p>As the committee was having 15 members and as per the procedure of nominations described in the debates Dt. 10.12.1946, the Secretary received only 15 nominations. Hence Dr. Rajendra Prasad declared all the nominated members as the members of the Committee for Rules of Procedure. Here are the name as follows:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The Hon&#8217;ble Mr. Jagjivan Ram.<\/li>\n\n\n\n<li>Mr. Sarat Chandra Bose.<\/li>\n\n\n\n<li>Mr. F. R. Anthony.<\/li>\n\n\n\n<li>Diwan Bahadur Sir Alladi Krishnaswami Ayyar.<\/li>\n\n\n\n<li>Bakhshi Sir Tek Chand.<\/li>\n\n\n\n<li>The Hon&#8217;ble Mr. Rafi Ahmad Kidwai.<\/li>\n\n\n\n<li>Shrimati G. Durga Bai.<\/li>\n\n\n\n<li>Dr. Joseph Alban D&#8217;Souza.<\/li>\n\n\n\n<li>The Hon&#8217;ble Diwan Bahadur Sir N. Gopalaswami Ayyangar.<\/li>\n\n\n\n<li>The Hon&#8217;ble Shri Purushottam Das Tandon.<\/li>\n\n\n\n<li>The Hon&#8217;ble Srijut Gopinath Bardoloi.<\/li>\n\n\n\n<li>Dr. B. Pattabhi Sitaramayya.<\/li>\n\n\n\n<li>Mr. K. M. Munshi.<\/li>\n\n\n\n<li>The Hon&#8217;ble Mr. Mehr Chand Khanna.<\/li>\n\n\n\n<li>Sardar Harnam Singh.<\/li>\n<\/ol>\n\n\n\n<p>Then Rajendra Prasad wen round and shook hands with all the members present in House on that day.
