2.49 Delegation of powers<\/u><\/strong><\/p>\n\n\n\n

2.49.1 Bare Act Provision:<\/strong><\/p>\n\n\n\n

MISCELLANEOUS<\/em><\/p>\n\n\n\n

29.<\/em> Delegation of powers.\u2015The Central Government may, by notification in the Official Gazette, direct that any powers conferred on it by or under this Act shall, subject to such conditions as may be specified in the direction, be exercisable also by\u2015<\/em><\/p>\n\n\n\n

(a) such officer or authority subordinate to the Central Government, or<\/em><\/p>\n\n\n\n

(b) such State Government or such officer or authority subordinate to the State Government,<\/em> as may be specified in the direction.<\/em><\/p>\n\n\n\n

2.49.2 Delegation of Powers<\/strong><\/p>\n\n\n\n

Section 29 of the Ancient Monuments and Archaeological Sites and Remains (AMASR) Act, allows the Central Government to delegate its powers under the Act to other entities. The Central Government can publish a notice in the Official Gazette to share its powers under the AMASR Act<\/a> with officers or authorities under the Central Government, e.g., Archaeological Survey of Bharat officials as per Clause (a) or with State Governments or their officers or authorities, e.g., state archaeology departments as per Clause (b). These delegated powers come with conditions set by the Central Government, and the specific recipients are named in the notice. This provision enables efficient administration of heritage protection by allowing the Central Government to delegate its powers to subordinate or state-level entities, ensuring flexibility in implementation while maintaining oversight through conditions, thus balancing centralized authority with localized execution.<\/p>\n\n\n\n
